Privacy Laws – It’s Not Just About Facebook

Read on: There have been major changes that have occurred in the world of laws and trends that affect you and your business in the last 10 years.
I have written about Internet privacy legislation and data breach protection but often you may be surprised at some of the laws and trends that may have affected you. These changes may affect you or your business in the following ways:

As a business owner, you should be aware of these changes that occur in the world of laws and trends that affect you and your business.
Facebook, Amazon, Google and Bitcoin
Facebook, the most visited website, is subject to little to no child-protection laws that apply to Google and Amazon, because they are not a consumer protection institution. On the other hand, the Wall Street Journal reports that Facebook to has admitted to a data breach that exposed the Facebook login details of 1.5 billion users.
Now, Facebook and a number of other social media platforms are required to provide informed consent for a request to remove a post. While this is definitely a step in the right direction, it is a start. But do you have the knowledge and experience to comply with the law?
New Laws Change Laws
There have been many updates and improvements to the law that affected the laws and standards of privacy, consumer protection and protection in your industry or business. Below are a few of the updates.
Children’s Internet Privacy Protection Act
Children under 13 are not allowed to use services on social media platforms unless the parents have given approval.
Do you know your child and/or business is eligible for the “Free Checking and Net Banking” service? On Facebook, the parent’s name is required for the child. So if your child is aged 13 or under, find out your details to be age-appropriate and receive the child’s bank account information.
GDPR (General Data Protection Regulation)
What this means for me and my business is that there is a 24 hour response period to your complaints under this law. You will know if your website has been breached within 72 hours and you will also know if your data was protected.
Visit police website (their user terms) if it is available. Many crimes are misdemeanours to warrant warrants for police inspection.
Timing of a data breach notification
The FCC has always required a timely notification to the consumer if the breach is classified as a “material fact”. We are seeing fewer and fewer breaches falling under this category.
To date, the “Material Fact” has been recorded in 60% of breach reports, but it has been reported to the FCC as a breach only once since 2016. This suggests that this is a rule that is slowly being pushed to the side.
If you have reported a breach under the previous requirements that are no longer in force, but have not received the notification yet, I strongly suggest contacting a privacy lawyer to advise you on options.
